General Terms and Conditions (GTC)
This is a convenience translation. The German version is the legally binding one. In case of differences, the German version prevails.
of XMS Immobilien UG (haftungsbeschränkt), Ballindamm 3, 20095 Hamburg (hereinafter the “Provider”), for the use of the platform “Angebix” at angebix.com · Version dated: October 5, 2026
Part A – General
§ 1 Subject matter and scope
(1) Angebix is an online platform on which companies (hereinafter “Businesses”) present their services and prices and on which visitors (hereinafter “Users”) can find Businesses, receive automatically calculated quotes and submit requests.
(2) Part A applies to all uses of the platform. Part B applies additionally to Users, Part C additionally to Businesses. Deviating terms do not become part of the contract, even if the Provider does not expressly object to them.
§ 2 Role of the Provider
(1) The Provider solely makes the technical platform available and arranges the contact between Users and Businesses. Contracts for the requested services (e.g. renovation, transport, cleaning) are concluded exclusively between the User and the respective Business. The Provider does not become a contracting party, representative or vicarious agent of a Business.
(2) The Businesses alone are responsible for the content of company profiles, in particular service descriptions, prices, qualifications and contact details. The Provider does not fully review this information and assumes no warranty for its accuracy, completeness or currency.
§ 3 Automatically calculated quotes
Quotes generated via Angebix are calculated automatically on the basis of the prices stored by the Business and the information provided by the User. They serve as guidance and are, unless the Business declares otherwise, a non-binding price indication by the Business. Scope, date and final price are agreed between the User and the Business.
§ 4 AI assistant
The digital assistant offered on the platform generates answers automatically with the help of artificial intelligence. The answers may be incomplete or incorrect and do not constitute advice. Only the information in the respective company profile or the agreement with the Business is binding.
§ 5 Reviews
(1) Users can review Businesses. Reviews must be based on the reviewer’s own experience and be truthful and objective. Not permitted are, in particular, insults, false statements of fact, advertising, and reviews of one’s own Business or of competitors.
(2) The Provider does not check reviews before publication but may remove impermissible reviews. Businesses can hide individual comments; the star rating continues to count toward the average. Notices of unlawful content can be reported at any time to support@angebix.com.
§ 6 Availability
The Provider endeavors to keep the platform available with as few interruptions as possible and aims for an availability of 98 % on annual average, but does not owe constant accessibility. Excluded are scheduled maintenance and disruptions outside the Provider’s sphere of influence (e.g. failures of internet or hosting service providers, force majeure).
§ 7 Prohibited use
Prohibited are, in particular, posting unlawful or misleading content, sending spam via request forms, automated queries (scraping), interference with the technical infrastructure, and attempts to access other parties’ accounts or data. The Provider may remove content and block access if there are specific indications of a violation.
Part B – Use by Users (search and requests)
§ 8 Free use
(1) Searching for Businesses, creating quotes, group requests and contact requests are free of charge for Users and possible without registration. This does not give rise to a contract for payment with the Provider.
(2) By submitting a request, the User agrees that the information provided will be transmitted to the selected Business or, in the case of a group request, to the selected Businesses so that they can contact the User. The User warrants that the information provided is accurate.
§ 9 Liability toward Users
Since use is free of charge for Users, the Provider is liable only for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). The Provider is not liable for the services of the Businesses.
Part C – Use by Businesses (subscription)
§ 10 Contracting parties and conclusion of contract
(1) The offering for Businesses is directed exclusively at entrepreneurs within the meaning of § 14 BGB (German Civil Code). By registering, the Business confirms that it uses Angebix for its commercial or self-employed professional activity.
(2) The presentation of the platform is not a binding offer. By completing registration, the Business submits an offer to conclude a contract of use; the contract is concluded when the account is activated. Access credentials must be kept secret.
§ 11 Services for Businesses
The Business receives, in particular, a public company profile, the ability to store services, prices and service areas, industry templates, automatically calculated quotes for Users, the forwarding of requests by e-mail, and display in the company search. The Provider continuously develops the platform further and may change functions, provided that the essential scope of services is preserved and this is reasonable for the Business. A specific number of requests or orders is not owed.
§ 12 Obligations of the Business
(1) The Business is responsible for the accuracy and lawfulness of its information, in particular for prices (including stating whether they include VAT), service descriptions, required permits and qualifications, and its statutory information obligations (e.g. legal notice (Impressum) details). It keeps its information up to date.
(2) The Business may use User data from requests only to process the respective request and is itself responsible for this under data protection law. Use for advertising without consent is prohibited.
(3) The Business grants the Provider the non-exclusive (simple) rights to uploaded content (e.g. logo, texts) that are necessary for operating the platform, in particular for public display in the company profile and in search results.
§ 13 Trial period, prices and payment
(1) The first 3 days from conclusion of the subscription are free of charge (trial period), unless a different trial period is stated at the time the contract is concluded (e.g. through a promotional code). Starting the trial period requires a payment method to be stored. If the subscription is not canceled before the end of the trial period, it automatically converts into a paid subscription.
(2) The price stated at the time the contract is concluded applies. It is currently 44.90 Polish złoty per month (including statutory VAT) for Businesses based in Poland, 9.90 € per month (including statutory VAT) for Businesses based elsewhere in Europe and 9.90 US dollars per month plus any applicable taxes for Businesses based outside Europe. The fee is due monthly in advance and is collected via the payment service provider Stripe from the stored payment method. The Business receives an electronic invoice for this.
(3) If collection fails or the Business defaults on payment, the Provider may, after prior notice, hide the company profile from the search until the outstanding amount has been settled.
(4) The Provider may change the prices with a notice period of at least six weeks, effective at the start of a new billing period. In this case the Business may cancel up to the time the change takes effect; the announcement will point this out.
§ 14 Term and termination
(1) The subscription runs for an indefinite period and is extended by one month at a time. It can be canceled at any time, effective at the end of the current billing period, in text form (e.g. by e-mail to support@angebix.com) or via the button “Manage / cancel subscription” in the business area. A cancellation during the trial period ends the subscription upon expiry of the trial period without any costs being incurred.
(2) The right to extraordinary termination for good cause remains unaffected. Good cause exists for the Provider in particular in the event of serious or repeated violations of § 7 or § 12 or in the event of a payment default of more than two monthly fees.
(3) After the end of the contract, the company profile is no longer displayed publicly. The Provider deletes the Business’s data upon request, unless statutory retention obligations prevent this.
§ 15 Liability toward Businesses
(1) The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of a guarantee it has assumed.
(2) In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), i.e. an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the Business may regularly rely, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
(3) The Business indemnifies the Provider against third-party claims that are based on unlawful content in its company profile, insofar as the Business is responsible for this.
Part D – Final provisions
§ 16 Changes to these GTC
The Provider may change these GTC with effect for the future insofar as this is necessary for objective reasons (e.g. changes in the law or new functions). Businesses will be notified of changes by e-mail at least six weeks before they enter into force. If the Business does not object within this period, the changes are deemed accepted; the notification will separately point out this consequence. In the event of an objection, both parties may terminate the contract effective when the change enters into force.
§ 17 Data protection
Information on the processing of personal data is contained in the Privacy Policy.
§ 18 Applicable law and place of jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Vis-à-vis consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the state of their habitual residence.
(2) If the Business is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Hamburg.
(3) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
(4) The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
